Abstract This study examines the stability of legislative decisions in the European Union, both in terms of a risk of decision cycles and in terms of the frequency of gridlock situations. The risk of cyclical decisions depends on three parameters, the applied decision rules, the dimensionality of the conflict space and the heterogeneity of actor preferences.

The current crisis could lead us to expect an overall increase of conflicts in the EU legislative process and eventually a shift from a consensual system to a majoritarian system. This paper aims to assess the evolution of the EU legislative process for the period 1996-2014 and shows that legislative actors still comply with the norm of consensus. We provide explanations for this resilience and analyse its effects. The paper demonstrates that in a context of greater divisions between EU actors, the systematic search for compromise and consensus contributes to modify the legislative regime in the sense of a greater Malthusianism and instability.

The Politics of Decision Making in the Council of the EUThis paper examines the decision making of the Council of the European Union to gain insight into how consensus decisions emerge and how they change power allocations and influence the behavior of negotiators and voting blocs. It surveys rationalist and non-rationalist accounts of consensus decisions in the Council and concludes that rationalist explanations are more convincing. In this connection, the central argument of the essay is that consensus emerges as rational negotiators (a) coalesce into blocs dominant enough to win over and suppress opposing coalitions and (b) undertake strategies to avoid blame for failing to win consensus around their own preferred policy.

This thesis presents a theory of voting behaviour for the governments represented in the European Union's Council of Ministers and analyses a large original data set covering all legislation adopted by the EU from 1999 to 2004. It argues that the governments' voting behaviour is dominated by party political preferences rather than national preferences over EU integration issues. The already very elaborate EU policies and processes for adopting laws mean that most issues related to decisions on the degree of integration are solved outside the Council. Instead, decision-making in the Council is over actual policy content and the level of regulation. Consequently, the governments negotiate over possible policy outcomes along the traditional left/right political dimension. Despite the use of qualified majority voting, a high percentage of decisions in the Council of the European Union are still made by consensus. Frank Hage outlines a model which can potentially explain this phenomenon. He argues that the high numbers of decisions made by consensus are in fact an unintended by-product of coalition building within the Council: states band together to form blocking coalitions, with eventual decisions reflecting a compromise between these coalitions (and therefore a consensus between all states). This explains why decisions made by consensus are still extremely common, despite the EU enlargements which have taken place since the mid-1990s.
