1.2 Scope<br />

This standard specifies Israel's phytosanitary requirements for the stated<br />

commodities and commodity classes only. If a commodity or commodity group is<br />

not identified within Section 3 or Section 4 exporters should contact:<br />

commodity not identified within an ICPR, is undertaken on a cost recovery<br />

1.3 Phytosanitary Legislation<br />

The following legislation controls the importation of plants and plant materials into<br />

Israel:<br />

Regulations Concerning Plant Protection (Import of Plant Products, Pests and<br />

Regulated Articles) 2009 (PPIS)<br />

1.4 Definitions<br />

Area – Country, part of a country or all parts of several countries;<br />

Pest free area – An area in which a specific pest doesnot occur or is being officially<br />

controlled;<br />

International Plant Protection Convention (IPPC) –A convention on Plant<br />

Protection published in 1997 by the Food and Agriculture Organization (FAO), and<br />

deposited for public view in the library of the Plant Protection and Inspection Services<br />

of the Ministry of Agriculture and Rural Development (hereafter, the Ministry of<br />

Agriculture);<br />

Country – A state, and in respect to a union of states any of the states forming part of<br />

the union;<br />

Country of exit - The country from which the consignment was sent to Israel;<br />

Country of origin – The country where the plants, plant products or regulated articles<br />

were grown or produced;<br />

Director – The director of the Plant Protection and Inspection Services of the Ministry<br />

of Agriculture and Rural Development or a person appointed for the purpose of these<br />

regulations;<br />

Agreement on the Application of Sanitary and Phytosanitary Measures (SPS) –<br />

International Agreement on the application of Sanitary and Phytosanitary measures<br />

published in 1994 by the World Trade Organization (WTO);<br />

Post Entry Quarantine – Quarantine applied to a consignment after entry, according<br />

to regulations;<br />

Propagation Material – seedlings, cuttings, plantlets, budwood, tissue cultures, roots,<br />

bulbs, tubers, seeds, mushroom spores, or any other part of a plant imported for<br />

propagation and cultivation;<br />

Treatment – Action taken in accordance with the methods described in the<br />

regulations, with the purpose of preventing introduction of pests into Israel;<br />

Re-Export – A consignment imported to Israel and later exported, without being<br />

exposed to contamination by pests;<br />

Plant Product – As defined by the Law and excluding those products of plant origin<br />

that underwent a process of freezing at a temperature below -18°C or roasting at a<br />

temperature above 185°C for a period of at least 15 minutes;<br />

Package - A packing unit for the import of a consignment;<br />

Official Laboratory – A laboratory recognized by the Plant Protection Organization of<br />

the Country of Origin or the Country of Exit, as applicable; should a laboratory test be<br />

required after arrival of the consignment to Israel, it will be done by the laboratory of<br />

the Ministry of Agriculture or by another laboratory approved by the Director;<br />

Inspector – Any person appointed under section 10 of the Israel Law;<br />

Growing Medium – Any material in which plants are sown, rooted or grown, excluding<br />

soil, sand compost and organic waste;<br />

Consignment - Plants, plant products, pests, or any other regulated articles moved<br />

from one country to another;<br />

Consignment in Transit – A consignment imported to Israel for the purpose of being<br />

passed to another country as is;<br />

Pest – Any species, strain, or biotype of plant or animal, including bacteria, viruses,<br />

fungi or weeds, injurious to plants;<br />

Quarantine Pest - Any pest listed in Annex 2 (Quarantine Pests)or any other pest not<br />

present in Israel or not established therein;<br />

Latent Pest – A pest existing in a plant without showing symptoms;<br />

Port of Entry – The sea ports of Ashdod, Haifa and Eilat, Ben-Gurion airport, or any<br />

other entry point authorized by the Director;<br />

Treatment Manual – A manual describing the treatments of a consignment, amended<br />

periodically by the Director, and deposited for public view in the library of the Ministry<br />

of Agriculture;<br />

Genetically Modified Plant – A plant modified by means of Genetic Engineering;<br />

Official Quarantine Station – A place officially held and managed by the Government<br />

for the purpose of inspection and growing of a consignment of plants according to<br />

regulation 10(C);<br />

Phytosanitary Certificate – Certificate of Plant Health patterned according to the<br />

IPPC;<br />

Certificate of Origin – A certificate issued in the Country of Origin by an authority<br />

recognized by the Director for the purpose of identifying the origin of the consignment.<br />

Note: No person shall import articles listed above, however Israel may grant an<br />

import permit for these articles if the importation is needed for purposes of<br />

research or the development of agriculture in Israel.<br />

If an import permit is granted the consignment will be held in an Official<br />

Quarantine Station or in another place authorized by the Director with the<br />

consent and at the expense of the importer, and will not be released until<br />

inspected by an inspector and found free from pests.<br />

2.2 Phytosanitary Import Permits<br />

2.2.1 Phytosanitary import permits state the phytosanitary requirements for importation.<br />

No person shall import plants, plant products, pests or regulated articles without<br />

a written import permit unless specified in the specific commodity requirements.<br />

A person importing articles listed in Annex 3 (see below) or goods identified in<br />

the specific commodity section as being exempt from import permits but<br />

requiring phytosanitary certificates, excluding Genetically Modified Plants or<br />

Plant products and excluding articles for re-export and articles imported in hand<br />

baggage, will be exempt from the need of an import permit provided that;<br />

1) The importer of an article listed in Annex 3 (see below) will attach to the<br />

consignment a Certificate of Origin;<br />

2) The importer of an article identified in the specific commodity section as not<br />

requiring an import permit will attach to the consignment a phytosanitary<br />

certificate, and in the case of propagation material, a certificate from a relevant<br />

authority in the country of origin, recognized by the Director, stating that the<br />

plant is not Genetically Modified;<br />

3) The importer of plants listed in Annex 3 (see below) and specific<br />

commodities listed not requiring an import permit will not use the plants for<br />

propagation, unless they were imported for this stated purpose.<br />

Annex 3: Goods exempt from the requirement for an import permit and<br />

phytosanitary certificate but requiring a certificate of origin<br />

(1) Dried fruit, dried vegetables and dried herbs;<br />

(2) Dried flowers, leaves and branches for herbal infusions;<br />

(3) Dried grains for human consumption, animal feed or oil extraction, excluding<br />

cotton seeds (Gossypium hirsutum);<br />

(4) Wood products and railway sleepers, excluding wood logs, wood bark and<br />

wood chips;<br />

(5) Nuts, for human consumption, without shells, excluding peanuts (Arachis<br />

hypogaea) and pecans (Carya illinoinensis);<br />

(6) One Etrog (Citrus medica) for personal use for religious purposes;<br />

(7) Cut flowers and branches<br />

(a) Dried, having undergone a chemical or fumigation treatment prior to<br />

shipment, in accordance with the requirements detailed in the Treatment<br />

Manual, and accompanied by an official Treatment Certificate issued by the<br />

Plant Protection Organization or of the country of origin or the country of export,<br />

as appropriate;<br />

(8) Packing material<br />

2.2.2 Phytosanitary import permits are required for the importation of the following<br />

commodity classes from <strong>New</strong> <strong>Zealand</strong>:<br />

2.2.3 Phytosanitary import permits and conditions of import may be requested from:<br />

2.3 Phytosanitary Certificates<br />

2.3.1 An importer of a consignment, unless containing a commodity listed in Annex 3<br />

(Phytosanitary Import Permit section), must attach to the consignment a<br />

phytosanitary certificate, in the original, of the Country of Origin, and present it<br />

to an Inspector at the Port of Entry.<br />

A consignment coming from a Country of Exit different from the Country of<br />

Origin will be accompanied in addition to a phytosanitary certificate of the<br />

Country of Origin with a phytosanitary certificate of the Country of Exit and will<br />

bear the stamp and signature of an authorized person by the NPPO of the<br />

Country of Exit.<br />

A phytosanitary certificate will not be valid unless the consignment was<br />

inspected by an authorized person in the Country of Origin-<br />

(1) Within 14 days prior to dispatch of the consignment if it contains vegetative<br />

propagation material, fresh fruits and vegetables, flowers or pot plants;<br />

(2) Within 30 days prior to dispatch of the consignment if it contains articles not<br />

listed in paragraph (1).<br />

Phytosanitary certificates are required to accompany the following commodity<br />

classes from <strong>New</strong> <strong>Zealand</strong>:<br />

fresh fruit and vegetables<br />

fresh and dried cut flowers and foliage<br />

all nursery stock<br />

seeds, grains and nuts for sowing<br />

nuts with shell<br />

growing media<br />

2.3.2 Phytosanitary certificates are not required to accompany the following commodity<br />

classes from <strong>New</strong> <strong>Zealand</strong>:<br />

frozen fruit and vegetables<br />

Annex 3: Goods exempt from the requirement for an import permit and<br />

phytosanitary certificate but requiring a certificate of origin<br />

2.6 Inspection on Arrival<br />

• All consignments of imported plant material are subject to inspection on<br />

arrival.<br />

• The importer shall submit to the inspector all original documentation relating<br />

to the consignment and present the consignment for inspection in such<br />

manner as the inspector may require.<br />

• An inspector may inspect the consignment outside the port of entry; the<br />

importer shall move the consignment to the place of inspection at his/her<br />

expense and on his/her responsibility.<br />

• As long as an inspector has not allowed the introduction into Israel of a<br />

consignment, or allowed its entry for the purpose of inspection it shall not<br />

be transferred from its storage place, its packing shall not be opened and it<br />

shall not be dealt with in any manner except in accordance with the<br />

instructions of the inspector.<br />

NOTE: If an inspector finds that a consignment does not comply with the<br />

regulations, or that the consignment is not free from pests, or it appears that the<br />

consignment contains latent pests, they may instruct the importer to take one or<br />

more of the following measures:<br />

(1) Destroy the consignment or part thereof in such time and such manner as<br />

designated by the inspector;<br />

(2) Disinfest the consignment or part thereof in such time and such manner as<br />

designated by the inspector;<br />

(3) Test the consignment in an official laboratory;<br />

(4) Remove the consignment to a post-entry quarantine facility and hold or grow<br />

it in such a place for such a time and in such manner as designated by the<br />

inspector;<br />

(5) Remove it out of Israel within such time and in such manner as designated;<br />

if the importer fails in doing so, the inspector may take action at the expense of<br />

the importer.<br />

If an inspector finds a quarantine pest listed in Annex 2 (Quarantine pests) or a<br />

quarantine pest notified by the Director in a consignment, the importer shall be<br />

instructed to destroy the consignment or remove it out of Israel, within such<br />

time and in such manner as designated. If the importer fails in doing so, the<br />

inspector may take action at the expense of the importer.<br />

The Director may allow, upon a request by the importer, entry of the<br />

consignment, in accordance with the treatment and conditions designated by<br />

him, provided that the consignment is not propagation material or pot plants.<br />

The inspector will not order the destruction of a consignment, in accordance<br />

with this regulation, unless, there is a reasonable pest risk; or, in the event that<br />

the exporter fails to remove the consignment from Israel within such time and in<br />

such manner as instructed by the inspector.<br />

2.7 Sampling Rates (on arrival)<br />

For the following commodity classes, 100% of the consignment will be inspected<br />

on arrival:<br />

For all other commodity classes a percentage of consignments will be sampled.<br />

Israel has not specified this percentage.<br />

Organism”<br />

No materials of plant origin can be utilised for packing a consignment, except<br />

dried moss, peat, ground cork and rock wool, unless granted an import permit.<br />

No previously used packing materials are to be utilised unless they are treated<br />

in a manner approved by Israel, and the treatment is recorded on the<br />

phytosanitary certificate.<br />

All wooden packing material must be marked according to standard ISPM 15 of<br />

the IPPC; wood packing material includes pallets and supporting beams.<br />
