Accommodating Ambassadors

Pensacola’s Downtown Improvement Board (DIB) launched a new program on Oct. 1 that will help keep the downtown area clean and welcoming. The DIB hired three new downtown ambassadors who will be working seven days a week to bring more beauty and hospitality into the downtown area. DIB Executive Director, Curt Morse, says he is tired of the environmental neglect he sees when he is downtown. “There are 44 blocks of downtown area. I see and manage all of it every day and I am disappointed with what it is at the moment. I see pieces of trash, cigarette butts, graffiti, weeds, all of these things,” he said. “These little things that people see every day that aren’t little things at all— they are big things and they’re about to change.” Morse spoke of how business owners in the downtown area work hard to keep their businesses clean and constantly strive to create a nice atmosphere and experience for their customers. “The moment visitors step over that threshold onto the downtown sidewalk, their experience should be just as good as it was in the restaurant or store or gallery they were just in,” he added. “The genesis of our program is to put people on our streets and sidewalks downtown everyday working to affect the appearance and experience that visitors, residents and property owners have when they’re downtown.” The ambassadors for this program are part of a non-profit organization called Pathways for Change, which helps men and women coming direct-

ly from prison as they start their new life and re-enter society. Pathways for Change also takes individuals that have been convicted of a minor felony and, rather than incarcerating them, allows them to learn trades and vocations that will be useful down the road. This way they are not only helping themselves, but are able to dedicate time to community service. “This organization is great because there is a higher possibility these men and women won’t revert back to the life they were living before and now they can have jobs,” Morse said. “I want to pay this company to hire these talented people that will help bring the beauty back to downtown and take care of the things the city doesn’t cover.” Chris Collins, Chief Operating Officer of Pathways for Change, said they are very excited about the launch of the program. “It is a great opportunity for these men to be a part of this project as ambassadors. It will teach them good citizenship and to take pride in this community,” Collins said. “We really appreciate the support this is getting, and we are excited to be a part of showing everyone how beautiful downtown can be.” The ambassadors that have been selected will be coming from the Everything Outdoors program at Pathways for Change. “We already had a crew from Everything Outdoors and these men met the requirements and the expectations that we had in mind. This program helps

men develop skills that employers are looking for: effective communicating skills, problem solving skills, team work and other things they might have otherwise missed out on,” Collins said. Morse says the program is looking for people that will identify what detracts from the beauty of downtown and who can rectify that detraction. “We are looking for competent individuals that can see where things do not belong, whether that is chipped paint on a light pole or the two million pieces of gum stuck on the side walk,” Morse said.

“The genesis of our program is to put people on our streets and sidewalks downtown everyday working to affect the appearance and experience that visitors, residents and property owners have when they’re downtown.” Morse says he realizes the downtown area isn’t quite Disney World, but it is an entertainment hub and it matters what visitors think when they experience it. “When people go back home to Pittsburgh or Houston or England, wherever it may be, I want them to go back and tell their friends and families how beautiful our downtown area is. Maybe they went to one of our delicious restaurants or saw a show at Vinyl or bought something unique from one of our stores. I want visitors to look at downtown as a

destination, just as much as they do the beach,” he said. When asked about the origin of the program, Morse said his peers in Mobile, Alabama have a similar program that Pensacola has been using as a model. He noted these programs are actually all over the place: New Orleans; Denver; Tampa; and Greenville, South Carolina. Morse and the DIB are using these programs as prototypes for what the Pensacola ambassador program should be. “This is not a unique program, but I am so grateful for the opportunity to be able to start this up locally,” he said. Along with keeping the beautiful downtown area neat and clean, the ambassadors will also help make visitors feel welcome. They will be present on the street ready to answer any questions visitors might have and they will be looking for any opportunity to engage the public. Morse says that one of the most important things these new ambassadors will have are hospitality skills—as a huge part of their job is to make visitors and locals feel more at home. They will have brochures and answers readily available for anyone who is looking for something specific or simply needs a recommendation for something fun to do. Morse says that he is extremely excited for what the future holds for these new ambassadors and downtown Pensacola. “This is long term, this is forever,” says Morse. “This is a new start for downtown.”

Area schools earn top honors at 10th annual Emerald Coast BEST Robotics Competition

The University of West Florida hosted the 10th annual Emerald Coast BEST Robotics competition on Saturday, Oct. 28. The project-based STEM program inspires middle and high school students to pursue careers in engineering, science and technology through participation in a sport-like competition to design, program and build a robot. This year, 585 students from 22 schools in Escambia, Santa Rosa, Okaloosa and Walton counties participated in the six-week program, beginning with the kickoff event on Sept. 16 and ending with Saturday’s Game Day competition. The winners of this year’s event, who will compete at the regional championship at Auburn University in December, include Seaside Neighborhood School, Pensacola Catholic High School, Woodlawn Beach Middle School and Brown Barge Middle School. Sam Russel, hub director for Emerald Coast BEST Robotics and program manager and instructor in the UWF Department of Electrical and Computer Engineering, said the annual competition is helping prepare today’s students for the future workforce. “Studies are showing that over the next few decades, the majority of jobs will require a higher knowledge of robotics, automation, and artificial intelligence,” Russel said. “Students need to be ready, and this competition gives them the opportunity to start learning those necessary skills, providing a ‘heads up’ for their future careers.” As part of the program, students and teachers are invited to attend programming classes taught by UWF engineering faculty members. The trainings, as well as the kits and resources to build the ro-

bots for the competition, are funded by the University and provided at no cost to area schools. Funding for the program is provided through the University’s partnership with industry leaders, including Gulf Power, AT&T and International Paper, as well as organizations such as the Institute of Electrical and Electronics Engineers Northwest Florida Section and the American Society of Heating, Refrigerating and Air-Conditioning Engineers Northwest Florida Chapter, in an effort to bridge a pathway between K-12 education, college and industry needs. The ultimate goal is to educate and retain the leaders of tomorrow to bring innovation to the Gulf Coast. Each competition is based on a real life product-to-market scenario that gives students the opportunity to experience exactly what it takes to start a business. Teams competing for the overall “BEST” award gave marketing presentations to convince potential investors that they were the best for the job. This year’s theme was fighting fires using robots. Teams were tasked with building fire-fighting robots capable of rescuing a mannequin, removing hazardous material and putting out a fire. Russel credited Vaughn Nichols, electrical engineer and key account manager for health care and universities at Gulf Power, with working hand in hand with the University to provide engineers for training sessions, participate in the event’s steering committee and judging the competition. Fire Department Hires New Cadets The Pensacola Fire Department had another historic week for hiring last week. Six new cadets joined the City of Pensacola and began their training at the Fire Academy on Monday, October 30. Included in this new class of cadets are the first two females hired by the Fire Department in over 16 years. Chief David Allen says bringing the cadet program back as a recruitment tool last year has allowed the department to hire more local applicants who want to live and work in Pensacola as well as increase the diversity of the department to better reflect the community. The program provides the education cadets need to become a certified firefighter and pays them for on the job experience. Since February, eleven cadets have completed the program and joined the Pensacola Fire Department

as professional firefighters. This latest class of cadets will also be the first class to complete their training at the George Stone Technical Center which allows the cadets to train locally. According to Chief Allen, the partnership with GSTC is beneficial to both parties, “We have the drill facilities for the practical (hands on) instruction, while GSTC has state of the art classroom facilities. Sayre Named Double-A Sports Turf Manager of the Year Following five straight seasons being named the Southern League Groundskeeper of the Year, Ray Sayre has been named Double-A Sports Turf Manager of the Year sponsored by the Sports Turf Managers Association and John Deere. “It is such an honor to be recognized for not only my work, but for the work our entire grounds crew accomplishes,” said Ray Sayre. “It has been amazing to see the organization go from construction of the stadium to winning a championship.” Recently named the Head Groundskeeper at Carpenter Complex, the spring training site of the Philadelphia Phillies and Gulf Coast League Phillies, Sayre worked with the Blue Wahoos since December of 2010, before the 2012 inaugural season at Blue Wahoos Stadium. “We are thrilled for Ray to be recognized for his hard work that we were able to first hand for six seasons,” said President Jonathan Griffith. “Ray created and maintained a first-class field for the Southern League teams to play on the past six years. I have never seen an employee so dedicated to the care and upkeep of a field.” “Our minor league members continually demonstrate uniqueness and skill while maintaining safe and playable surfaces,” says Kim Heck, CAE, CEO of STMA. “The high-quality submissions

illustrate the individual merits for winners and we’re proud to honor their truly fantastic results.” With over 17 years of experience, Sayre joined the Blue Wahoos before the inaugural season during construction of the facility in December of 2010. Since 2013, Sayre has been voted Groundskeeper of the Year by Southern League managers and umpires. Serving as a multi-use facility, the Blue Wahoos host over 120 games and events with Sayre leading the setup of all activities on the field, including University of West Florida Division II football. Before making the move to Pensacola, Sayre previously worked for several minor league teams including the Louisville Bats, Greenville Drive and Bowling Green Hotrods. Growing up in Lexington, Ky., Sayre graduated from Eastern Kentucky University with a degree in Turfgrass Management. Since 2000, STMA and MiLB have honored members who manage fields in Triple-A, Double-A, Single-A and Short Season or Rookie divisions. Winners are selected via a 13-member awards committee, compiled by STMA. Each nominee is independently scored on cultural practices, game day routine, resource utilization, staff management and the groundskeeper’s involvement and support of the sports turf industry.

PSC Art Faculty and Staff Exhibit at Switzer Gallery

More than 100 select works from 23 professional artists are on display at the annual Art Faculty and Staff Exhibition at Pensacola State College’s Anna Lamar Switzer Center for Visual Arts, Building 15, on the Pensacola campus. The show is free and the public is invited to meet the artists at a reception from 6 to 8 p.m. on Thursday, Nov. 16. Featured through Jan. 12, 2018, the exhibition gives students and the community an up-close look at the creative efforts of Pensacola State’s widely respected visual arts faculty and staff. “There is always something new and exciting,” says Gallery Director Vivian Spencer. “Everyone pushed the envelope further from where they were last year.” A perennial favorite, this innovative exhibition includes ceramics, drawing,

Fike Named Manager, Communications, International Paper’s Pensacola Mill; Holmes Promoted to Manager, Communications, Global Manufacturing System

International Paper announced Whitney Fike has been named Manager, Communications for its Pensacola Containerboard and Pulp Mill in Cantonment, Fla. In her new leadership role, Fike will be responsible for the mill’s internal and external communications, which includes employee communications, media relations and community engagement. Most recently, Fike owned a public relations company, Sparkplug Social, and worked with clients on public relations plans, social media management and content development. She has a vast background of communications experience and has worked in a variety of sectors including not-for-profit, government, tourism, financial, entertainment and events throughout her career. Fike is a founding member of the local Lean In chapter, past-president of the Florida Public Relations Association Pensacola chapter and a 2012 graduate of

Leadership Pensacola. Fike and her family reside in the Pensacola area. In a related move, Janice Cooper Holmes has been promoted to Manager, Communications, Global Manufacturing System for International Paper. In her new leadership position, Holmes will provide strategic communications planning and support for IP’s Global Manufacturing System and serves as the subject matter expert for employee communications across the company, globally. Most recently, Holmes was the Manager, Communications for the Pensacola Mill and prior to that Director, Communications for the University of West Florida. Holmes is a past-president of the Junior League of Pensacola, a 2003 graduate of Leadership Pensacola and currently serves as chair of the Creative Learning Academy Board of Trustees. Holmes and her family will continue to reside in the Pensacola area.

As the holiday shopping season kicks in, visitors to Pensacola’s Cordova Mall will find the 5th Annual Rotary Tree of Remembrance. Benefitting several local charities, this year’s opening ceremony will be held Sunday, Dec. 3, at 3 p.m. in the mall’s food court. The Tate High School choir will provide sounds of the season and honored guests will include our local Pearl Harbor Survivors. This annual project invites the families of our community to place ribbons bearing the names of loved ones and special messages of love and hope on the Tree and to make a donation of their choice, which will support several local charities. Later, Boy Scouts of America will retire the ribbons at their annual U.S. Flag Retirement Ceremony at Veterans Memorial Park. In 2013, over $3,000 was collected when the area’s first Rotary Tree of Remembrance made its debut at Cordova Mall. In 2016, over $11,000 was collected with 1800 ribbons decorating the Tree during the holiday season. LATVALA REMOVED AS BUDGET CHIEF AMID HARASSMENT PROBE By DARA KAM THE NEWS SERVICE OF FLORIDA

Sen. Jack Latvala was stripped Monday of his powerful role as Senate budget chief during an investigation into allegations of sexual harassment, which Gov. Rick Scott called “disgusting.” Senate President Joe Negron launched an investigation Friday into the allegations about Latvala, first reported by Politico Florida. Latvala, a Clearwater Republican who is running for governor, has vehemently denied any wrongdoing. Negron on Monday ordered Sen. Rob Bradley, R-Fleming Island, to take over as chairman of the Appropriations Committee, saying in a memo “it is in the best interest for another senator to temporarily serve” in the position while the investigation is pending. Speaking to reporters on Monday, Scott called the allegations of sexual harassment against Latvala, a veteran lawmaker and political consultant, “disgusting,” and said, if true, he should be “out of office.” In the Politico report, six unidentified women accused Latvala of groping them or making

unwelcome verbal comments about their bodies. “That’s disgusting,” Scott said. “I’m blessed. I have a wife of over 40 years. I have two daughters. And when they’re in the workplace, I would be horrified if they were treated improperly. It’s disgusting if anybody does that.” Negron on Friday ordered Senate General Counsel Dawn Roberts to lead an investigation into the allegations. But a day later, Negron, R-Stuart, ordered an independent inquiry after Roberts asked to be taken off the case because she has long professional ties to Latvala. Scott said he was aware of the independent probe into the allegations lodged against Latvala. “We need to follow that and find out the real facts of what actually happened. It’s very important that there’s an investigation and we know what happened. If anybody has done anything wrong, they need to be out of office,” the governor said. “There should be no corruption in politics. We should expect all of our elected officials to live at the highest standards of our society. For me, I just think of my own family. I just can’t imagine what somebody would be going through if this is true.”

Scott is the latest high-ranking Republican to denounce the alleged sexual harassment, with Negron on Friday calling the accusations “atrocious and horrendous.” House Speaker Richard Corcoran, R-Land O’ Lakes, said Latvala should resign. “This behavior should never be tolerated. He should resign immediately,” Corcoran, who is widely expected to jump into the governor’s race, said in a statement Friday evening. “The most dangerous threat to self government is morally corrupt leaders acting in their own selfish interests.” But Latvala on Friday night issued a statement pointing to political motivations for the allegations. “I am in consultation with my attorney and will take all legal actions necessary to clear my name,” Latvala said in the statement. “I also welcome a complete review of these allegations by the Senate. If my political opponents want a fight, then it’s a fight they will get.” Senate Majority Leader Wilton Simpson, R-Trilby, will replace Bradley as chairman of the Senate Transportation, Tourism and Economic Development Appropriations Subcommittee.

A meeting on a proposed rule to require nursing homes to have generators that can power airconditioning systems was scheduled for two hours Friday afternoon, but it wrapped up in about 30 minutes. Despite the brevity, state Agency for Health Care Administration staff members heard concerns from emergency-management officials, representatives of two long-term care organizations and others who testified about the difficulties in complying with an emergency rule requiring nursing facilities to have generators and enough fuel to keep buildings cool for 96 hours. The emergency rule, issued in September after the deaths of residents of a Broward County nursing home, was invalidated last week by Administrative Law Judge Gar Chisenhall. But Gov. Rick Scott’s administration is appealing the decision while also working to implement the power requirements through a moretraditional rulemaking process, which requires public meetings. AHCA is the lead agency for the proposed rule, which applies to nursing homes, while the Florida Department of Elder Affairs is the lead agency on a generator rule for assisted living facilities. There was no draft of the proposed nursing-home generator rule for Friday’s meeting, so public testimony was tailored to requirements in the disputed emergency rules. Florida Health Care Association chief lobbyist Bob Asztalos asked in his testimony that a panel of interested parties be assembled and a mutually acceptable rule be developed. The process is known as “negotiated rulemaking” and, Asztalos said,

lawmakers authorized it as a “a tool to attain consensus” when considering complex rules. “I can think of no issue that better fits that definition,” Asztalos, whose organization represents hundreds of nursing homes, said of the generator rule. But Mallory MacManus, an AHCA spokeswoman, said the agency does not want to use the negotiated rulemaking process on the issue. “These life saving measures are too urgent to be dragged out in the negotiated rulemaking process,” MacManus said. “We will continue to work to make this rule permanent through the normal rulemaking process.” AHCA limited testimony from speakers at Friday’s meeting to three minutes. McManus said the agency used the limit to ensure that anyone who wanted to speak would have the opportunity and that it was set out of fairness. She said the agency gave additional opportunity at the end of the meeting for people to speak. Time ran short before Asztalos could discuss the proposed changes his association would like to see, including a change in a temperature requirement in the emergency rule. But in written remarks, Asztalos said two-thirds of nursing-home residents rely on Medicaid to pay for the care. “FHCA also asks that we identify funding sources to assist nursing homes in what could be a $230 million price tag for complying with this generator requirement,” Asztalos said. Jeff Goldberg, director of emergency management for Walton County, asked that in the permanent rule the state change a requirement that local emergency-management officials sign off on nursing-home generators as well as review emergency-management plans. “Emergency management doesn’t

have the expertise to certify a generator. I can operate a generator I can’t tell you whether that generator is adequate to cool a facility or cool part of that facility. The rule right now is putting that burden on emergency management,” he said. Attorney Karen Goldsmith has helped nursing homes across the state try to come into compliance with Scott’s emergency rules. She testified she has helped file more than 100 variances with the state because nursing homes cannot comply with a Nov. 15 deadline in the emergency rules to have generator in places and enough fuel to keep homes cool for 96 hours. “I’m pretty much familiar with what’s happening out there,” she said, adding that the time frames in the emergency rules are not reasonable. She said at a minimum, it would take 180 days for a nursing home to meet the power requirements. “When we pass a rule, it needs to be reasonable timing,” she said. AHCA did not say when it would publish the proposed rule or if it would hold another public meeting on the proposal. The Scott administration moved quickly to issue the emergency rules after the Sept. 13 deaths of eight residents of The Rehabilitation Center at Hollywood Hills, a Broward facility where the air-conditioning system was knocked out Sept. 10 by Hurricane Irma. Six other residents died after evacuation. Nursing homes and assisted living facilities immediately raised concerns about being able to comply within a 60-day timeframe. Along with going through more-traditional rulemaking, Scott also has called on the Legislature to put the generator requirements in law. While the AHCA meeting Friday wrapped in about 30 minutes the

Department of Elder Affairs’ meeting on the proposed power requirements lasted about 45 minutes, with speakers limited to five minutes. The Department of Elder Affairs did not provide to the public a draft copy of the policy it would like to implement and, similar to AHCA, did not commit to holding another public meeting on the proposed rule after it is published. Asztalos testified at the Department of Elder Affairs meeting that the emergency rules didn’t fix the problems at The Rehabilitation Center at Hollywood Hills. “This rule doesn’t do anything to address what happened in Hollywood Hills,” he said. “What happened in Hollywood Hills as far as we can tell is a breakdown in patient care. There is nothing in this rule that address that,” he said asking that patientcare standards, such as monitoring residents to ensure they aren’t victims of heat exposure should be included in the permanent rule. Steve Bahmer, president and CEO of the industry group LeadingAge Florida, asked that the state be flexible. For instance, some of his members are continuing care retirement communities, which means they have assisted living facilities and nursing homes located on the same campus. And in some instances, a common space between nursing homes and ALFs is cooled and is a safe area where assisted living facility residents could be moved if a problem arises. He noted that a continuing care retirement community in Tallahassee has an auditorium that is used by both the nursing home and the ALF. “The problem is, of course, the rule they have been dealing with for the last 47 days requires them to install a generator in an assisted living building, which essentially renders the common area in their auditorium moot,” Bahmer said.

With the start of the 2018 legislative session more than two months away, House members, mostly Republicans, have pitched 114 projects and programs for state money. The proposals range from $30,000 for the Okaloosa County Historical Museum to $2 million for coastal work in Jacksonville Beach to $300,000 for drainage improvements in Miami Gardens. House Majority Leader Ray Rodrigues, who is vice chairman of the House Select Committee on Hurricane Response and Preparedness, said priority will be given to projects that can be linked to Hurricane Irma relief or to brace for future disasters. “My suspicion is, as we move forward in the process, the appropriation bills that are going to get a hearing deal with these topics more so than the bills that do not,” Rodrigues, R-Estero, said Thursday an Associated Press event at the Capitol. The House budget proposals for the 2018 session, which starts Jan. 9, totaled $117 million as of Friday morning. The House, unlike the Senate, requires members to file separate bills for proposed spending projects. Lawmakers face a tight budget going into the session,

in part because of costs related to Hurricane Irma. But Gov. Rick Scott said the state has enough money to pay for priorities without dipping into reserves. “I’m going to focus very aggressively on how we take care of families. I’m not, as you would expect, I’m not going to focus on member projects,” Scott said Thursday. “If we spend that money well, we will have the ability to, one, have significant reserves and to continue to reduce the debt of the state, which long-term is going to make it easier when we do, hope we never do, have a downturn in this state.” Rodrigues said he had not reviewed the proposed member projects but said House Speaker Richard Corcoran, R-Land O’Lakes, has made clear priority will go to efforts to respond to the hurricane, which caused billions of dollars in damage to the state Sept. 10 and Sept. 11. “If they cannot be fit within those parameters, then clearly those aren’t projects that will be viewed as a priority by the House as we move forward,” Rodrigues said. Among the House proposals, the two largest as of Friday are promoted as hurricane-related. A measure (HB 2191) by Rep. Colleen Burton, RLakeland, seeks $9 million for hurricane preparedness at Lakeland Regional Medical Center. An $8.4 million proposal (HB 2229) by Rep. Cary

Pigman, R-Avon Park, would fund an emergency special-needs multi-use facility in Okeechobee County. The next two highest proposals don’t appear to stormlinked. House PreK-12 Appropriations Chairman Manny Diaz, R-Hialeah, wants $5.2 million for tuition assistance for health professionals at Nova Southeastern University (HB 2091). Also, Burton has proposed $5 million for a behavioral-health hospital and outpatient center at Lakeland Regional Medical Center (HB 2189). Overall, Republicans had submitted 94 projects worth a combined $105.5 million. Democrats had 19 proposals on file worth a combined $11 million. One proposal (HB 2135), $580,320 for the Marion County Southeastern Livestock Pavilion, is sponsored by Republican Rep. Stan McClain of Belleview and Democrat Clovis Watson of Alachua. An additional five projects, worth a combined $2.93 million, were withdrawn on Thursday. Each had been sponsored by Daisy Baez, a Coral Gables Democrat who resigned Wednesday from her House seat as part of plea agreement involving perjury in an investigation about her legal residency. The largest of Baez’ proposals, $1.5 million, was for to assist a Pinecrest waterline extension project.

CAPITOL `CULTURE’ UNDER SCRUTINY AFTER CLEMENS EXIT By DARA KAM THE NEWS SERVICE OF FLORIDA

Two months away from home in a highly competitive environment that is fueled by money, power and booze and in which careers are made or broken based on relationships built mainly after hours. That’s the backdrop for the unfolding drama in Tallahassee in which insiders and onlookers have developed an obsession with who is sleeping with whom, and who will be the next to be outed. The prurient explosion began last week, when highranking Democratic Sen. Jeff Clemens resigned from his seat after admitting he had an extramarital affair with a lobbyist. On the heels of Clemens’s exit came news that state law enforcement officials are investigating a camera found by Senate Minority Leader Oscar Braynon in the hallway of a condominium building where he --- and other lawmakers --- live when they are in Tallahassee. Senate budget chief Jack Latvala, a Republican running for governor, was caught on camera kissing a female lobbyist on the lips. The duo denied that they are anything but friends. The microscope on the off-campus interactions and bedroom activities of lawmakers and lobbyists has prompted an examination of sexual harassment in the workplace and the conduct of legislators and staff. Everyone agrees that inappropriate behavior, such as unwelcome touching, is off-limits and should be punished. But what about the choices consenting adults make about what happens when the lights go out? To what degree does the Legislature’s influence-based culture play a role in those choices? And what’s the impact, if any, of pillow talk on public policy? The News Service of Florida explored those issues and others over the past week in more than a dozen interviews with veterans of the political process, most of them women who would only speak if they were not identified by name. Lobbyists feared retaliation from male legislators or other lobbyists. Legislators were afraid of ridicule or payback from male legislative leaders, or of jeopardizing relationships with lobbyists. What’s going on now in Tallahassee isn’t new, they said. Nor is it much different than the behavior that occurs in places like Hollywood, where accusations of sexual misconduct against movie mogul Harvey Weinstein have drawn national attention to the issue --and intensified the scrutiny of what’s going on in and around the Florida Capitol. “I feel strongly that there is a big gulf between consensual relationships between consenting adults and something that amounts to sexual harassment. But that

said, there has long been a culture in places like state capitals or even Hollywood, Calif., where power plays an almost intoxicating role in how relationships get formed. The big, important element is whether someone is using their position of power to demand a relationship or sexual favors,” said Susan Glickman, a lobbyist who was the first chairwoman of the Florida Commission on the Status of Women after it was restructured in 1992. “There’s a big continuum on which that balance of power can operate.” When asked about how business gets done in Tallahassee, Lori Killinger, a veteran lobbyist who’s also a lawyer, compared sexual favors to the money used to influence or gain access to lawmakers. “In the same way that campaign contributions can play a significant role in how important public policies are adopted, sex can also drive decisions legislators make about public policy,” Killinger said. But, unlike financial-disclosure requirements for lobbyists, legislators and candidates, details about intimate --- or even casual --- sexual relationships are secret. That’s why it’s important for public officials, or others in positions of power, to exercise self-control, many women said. The legislative environment is a “fictitious world,” said Nikki Fried, a lawyer and lobbyist. “You’re away from your family. You’ve got highenergy high stress, a lot on the line, and alcohol” thrown into the mix, Fried said. “No matter where you are, you’re going to get the same interaction. It’s just that some of these people are elected. That’s why it’s newsworthy,” she said. Other women blame that atmosphere for a code of silence around inappropriate behavior that’s been tolerated and largely ignored. For example, no one ever complained about a legislator whose bear hugs and smooches kept women from closing the door when they went into his office. And people are aware of a checklist involving points for “bagging” women involved in the legislative process, with female senators targeted as the top prize. But when asked about it, the common response was to shrug it off because it’s been around for ages. “It was just surprising to me that it happened, the kinds of things that happened to me. Physically being touched, things being said that were inappropriate, had not happened to me and I truly did not know how to deal with it,” said state Rep. Kristin Jacobs, a Coconut Creek Democrat who joined the Legislature three years ago after spending more than a decade on the Broward County Commission. “At first I was so blown away by it. I was like, what? Who do I talk to about this? What happens to my bills if I do? What’s the best way to

handle it? I just simply didn’t know what to do or who to talk to. Ultimately I figured it out and handled it on my own.” Braynon, who found the video camera in a hallway outside of his downtown condo and reported it to state police, said he thinks the scrutiny of lawmakers’ extracurricular activities could lead to a change in behavior. “I do think this is going to change some of the things that happen in Tallahassee, and in many ways for the better, especially when it comes to how males interact with females in this process,” Braynon, D-Miami Gardens, said. “There are a bunch of stories that a bunch of us here think, man, that’s pretty bad. If we can start with a new focus on respecting boundaries, that’s a good thing.” But some women are worried that a “knee-jerk reaction” could have a negative impact on female lobbyists, who already are at a disadvantage. The disclosures about Clemens came as lawmakers and lobbyists prepare for the January start of the 60-day annual session. Male lawmakers could become leery of meeting privately, or outside of the Capitol, with female lobbyists, but they won’t have a problem smoking cigars or drinking cognac into the wee hours with their male counterparts, one woman said. “This environment that they are now creating has made everybody so overly sensitive that it will actually hinder us from being able to do our jobs,” one female lobbyist said. Creating a safe process for men and women to report sexual harassment or other misconduct is critical, said Sen. Lauren Book, a Plantation Democrat who was molested by her nanny when she was a child. But a frustrated Book believes that the focus on the sexual conduct of her colleagues is a distraction from the work legislators were elected to perform. Addressing the state’s opioid crisis, which is responsible for the deaths of 14 Floridians each day, is one of the Legislature’s top priorities for the 2018 session. “So 84 people have died since Jeff Clemens resigned and we’re still talking about who’s having sex with who. What are we doing?” Book said Wednesday. “This brought to light a culture problem. We’re going to set up policies and procedures to address the problem. But let’s get back to what we’re here for. As much as I want to change every culture that exists, this culture has been here long before I’ve gotten here and it’s going to exist after I leave here because it is a male-dominated world. That’s the reality.”

BUSINESSES TO GET WORKERS’ COMP RATE CUT By CHRISTINE SEXTON THE NEWS SERVICE OF FLORIDA

State Insurance Commissioner David Altmaier has ordered a 9.8 percent decrease in the premiums businesses pay for workers’ compensation insurance beginning next year. He also ordered the National Council on Compensation Insurance to include in all future recommended rate filings a “quantitative analysis” of the impact that eliminating attorney-fee caps have had on the workers’ compensation system. NCCI is an organization that files recommended rates on behalf of insurance companies. In a final order Tuesday, Altmaier rejected a recommended 9.6 percent rate reduction filed by NCCI and ordered it to file by Nov. 7 a slightly larger 9.8 percent reduction. The Office of Insurance Regulation said a 2 percent profit and contingencies provision in the NCCI filing was “excessive” and ordered it lowered to 1.85 percent. In a statement, NCCI said it’s in the process of reviewing its filing to comply with the order by Nov. 7. Workers’ compensation is a no-fault system meant to protect workers and employers. It is supposed to provide workers who are injured on the job access to medical benefits they need to be made whole. Those who are injured for at least eight days also are entitled to indemnity benefits, or lost wages. In exchange for providing those benefits, employers generally cannot be sued in court for causing injuries. Florida businesses paid nearly $3.8 billion in

workers’ compensation premiums in 2016, up from about $2.8 billion in 2012. The costs for the mandatory coverage are the 33rd highest in the nation, according to NCCI. Bill Herrle, executive director of the National Federation of Independent Business-Florida, said small-business owners will benefit under Altmaier’s order. “Any rate reduction is welcomed news,” Herrle said. “We have the confidence in the insurance commissioner that the rate reduction is merited.” Altmaier’s near 10-percent reduction is more conservative than what the group Florida Workers’ Advocates proposed at a public hearing last month. Stephen Alexander, an actuary for the association, testified that rates should be reduced by an average 15.4 percent. Nevertheless, the reduction in 2018 rates is in stark contrast to a 14.5 percent increase that was approved last year. That hike went into effect in December 2016 and was filed to reflect two Florida Supreme Court rulings as well as increases in the rates paid to health providers who treat injured workers. The 2016 filing, NCCI said, was a “law only” filing, reflecting changes to the system. The 2017 filing was based on experiences for policy years 2014 and 2015 as they were valued at year-end 2016. In Tuesday’s order, the Office of Insurance Regulation directed NCCI to include in its future recommended rate filings a detailed analysis of the impact of Castellanos v. Next Door Company, a 2016 Florida Supreme Court ruling that struck down caps on fees for attorneys who represent injured workers.

“The analysis may include alternative data sources and should examine changes to the Florida workers’ compensation market that are attributed to or observed as a result of the recent court decision,” the order said. “These changes include, but are not limited to, reopening of claims from older years, changes in reserves or payment patterns, changes to claim closures or settlement rates, changes to claim frequency and severities, increasing attorney involvement and fees paid to attorneys.” Florida Workers’ Advocates President Mark Touby in a statement said he was pleased that Altmaier recognized deficiencies in the existing rate process. “It is tremendously troubling that NCCI has admitted that last year’s 14.5 percent rate increase was not based on any relevant data, but was instead based on market projections. The fact that we are now facing a significant rate reduction raises the question of whether last year’s hasty rate increase was justified --- or alternatively, whether it was an avenue to overcollect premiums from Florida businesses based upon NCCI’s myth that there was an unfunded liability. Either way, this process is in serious need of reform, and we are pleased that Commissioner Altmaier has recognized the deficiencies in the existing NCCI process,” the statement said. NFIB’s Herrle is confident that NCCI”s analysis will show the elimination of the fee caps will increase attorney involvement in the system and, therefore, drive up rates. “We’re OK waiting to get our I-told-you-so’s on that one,” he said. “We believe that unrestricted attorneys’ fees will eventually catch up with us.”
