AS OF JULY 2015, IT’S THE LAW! VA Code § 32.1-370: Mothers have the right to breastfeed in public in Virginia. A mother may breastfeed in any place where the mother is lawfully present.

Businesses, public institutions and events can introduce breastfeeding-friendly practices such as:

  • Displaying signs notifying breastfeeding-friendly policies

  • Providing clean and welcoming lactation rooms or spaces

  • Training staff on breastfeeding-friendly practices


Employers can introduce breastfeeding-friendly practices such as:

  • Providing clean and welcoming lactation rooms or spaces

  • Training staff on breastfeeding-friendly practices

  • Offering extra break time for lactating mothers

  • Granting flexible work hours or work-at-home policies

  • Exploring ways for babies to come to work

  • Providing on-site day care

  • Granting generous paid parental leave


Affordable Care Act provisions for breastfeeding require an employer to:

  • Provide reasonable break time for an employee to express breast milk for her nursing child for one year after the child's birth each time such employee has need to express milk. The employer is not required to compensate an employee receiving reasonable break time for any work time spent for such purpose.

  • Provide a place, other than a bathroom, for the employee to express breast milk. (Note: all employers are subject to the break time requirement unless they have fewer than 50 employees and can demonstrate that compliance would impose an undue hardship. Click here for further guidance).
